These terms govern access to and use of the CBA broadcast platform at creativebroadcast.com ("the platform"), including any client workspace CBA operates on it. They apply to the client organisation for which a workspace is operated ("the client") and to every person who accesses that workspace ("viewers"). For a given engagement they are read together with the service agreement or accepted proposal for that engagement, which prevails over these terms where they differ.

1The platform and the service

  • CBA provides a managed broadcast platform: live streaming, on-demand replay, viewer registration, engagement features (questions, polls, chat where enabled) and workspace pages, operated by CBA for the client's event or programme.
  • The platform is provided as a managed service. CBA configures, operates and moderates it; the client observes and directs. Client administrative access, where granted, is read-only reporting unless the engagement states otherwise.
  • Features available to a workspace are those set out in the engagement. CBA may improve the platform continuously provided the engaged features are not reduced.

2Access and accounts

  • Access to a client workspace is restricted as agreed in the engagement, for example to the client's email domain, with sign-in by one-time code or by the client's own Microsoft Entra ID tenant. Named CBA production operators also hold access for operating the service; their accounts are excluded from client reporting.
  • Viewers must keep sign-in codes and links private. A session belongs to the verified individual and may not be shared.
  • CBA may suspend an account or session that presents a security risk, breaches these terms, or is reported by the client's administrator as unauthorised.

3Acceptable use

  • The platform may not be used to post or transmit unlawful, defamatory, infringing or offensive material; to probe, scan or test the security of the platform without CBA's written consent; to interfere with another viewer's access; or to copy, scrape, reverse-engineer or resell any part of the platform.
  • Recording, downloading or redistributing streamed content is not permitted except through export or download functions the engagement provides.
  • Questions, chat and other viewer submissions may be moderated by CBA before display, under the moderation model agreed with the client.

4Content and intellectual property

  • Client materials (branding, slides, video, event content) remain the client's property. The client grants CBA a licence to host, process, display and transmit them solely to deliver the engagement.
  • The platform, its software, design and know-how remain CBA's property. No rights in the platform are transferred by use of it.
  • Recordings produced under an engagement are delivered and owned as that engagement states.
  • The client is responsible for holding the rights to material it supplies, including music, imagery and third-party footage.

5Data protection and privacy

  • Viewer personal data is processed as described in the CBA Platform Privacy Policy (ref CBA/LEGAL/PRIV/2026-10-06) and, for a specific engagement, the Data Handling and Retention Statement issued for it.
  • CBA processes viewer data only to operate the platform and deliver the engagement, and does not sell it or use it for advertising.
  • Data captured in a client workspace is reported to that client only, excluding CBA operator accounts.

6Availability, support and security

  • CBA operates the platform on established cloud infrastructure and staffs live events with its own production team. Support during a live event is immediate and on-shift; outside events, support is by email during business hours.
  • Planned maintenance is not carried out during a client's scheduled live event.
  • Security controls are described in the CBA Web Platform Security Configuration Standard and the CBA Information Security and Privacy Policies, available to clients under review.

7Retention and deletion

  • Event recordings and viewer data are kept for the period agreed with the client organisation. Where no period has been agreed, recordings stay available to viewers for thirty days after the event and are then hidden from viewers, not deleted. Data is deleted on the client's written request, or at the end of the engagement. Before deletion, the client may request an export of its event data and recordings.
  • On termination of an engagement, client materials are returned or deleted as the engagement states.

8Liability

  • Nothing in these terms excludes liability that cannot be excluded by law.
  • Subject to that, CBA's total liability arising from or in connection with the platform in any twelve-month period is limited to the fees paid by the client for the engagement giving rise to the claim in that period, and neither party is liable to the other for indirect or consequential loss, loss of profit, or loss of data beyond the backups the engagement requires.
  • The platform depends in part on third-party networks and the viewer's own device and connection, which are outside CBA's control.

9Changes, term and termination

  • CBA may update these terms by issuing a new version to the client; the version in force for an engagement is the one current at the engagement's start unless the parties agree otherwise.
  • Either party may end platform access as the engagement provides. Sections 4, 5, 7 and 8 survive termination.

10Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, and the courts of the United Arab Emirates have jurisdiction.
